These terms govern the use of WACket's website, marketplace, and related services. By accessing or placing an order through our platform, you agree to the conditions below.

1. About Wacket

Wacket is a community-powered marketplace that connects customers with approved producers and suppliers of agricultural and related products.

By accessing, registering on, or using Wacket, you agree to these Terms & Conditions and all applicable laws of the Republic of Uganda.

Where Wacket is operated by another legal entity, these Terms & Conditions shall be read together with the governing documents, policies, and procedures of that entity.

2. Products, Quality and Traceability

Wacket works with approved producers and suppliers who follow established production, handling, quality assurance, safety, and traceability standards.

Products supplied through Wacket can be traced to their source and supplier.

Because agricultural products are natural products, they may vary in size, shape, colour, texture, appearance, weight, and maturity. Such variations do not constitute defects.

Product descriptions, images, and illustrations are provided for guidance and may not exactly match the products delivered.

3. Product Availability

All products are subject to availability.

Availability may be affected by seasonality, weather conditions, harvest yields, supplier capacity, transportation constraints, and other circumstances beyond Wacket's reasonable control.

Where a product becomes unavailable, Wacket may offer a suitable alternative, postpone delivery, or cancel the order.

4. Pricing and Payment

Prices displayed on Wacket may change without prior notice.

Payment instructions, including the authorized payment telephone number, will be provided upon order confirmation.

Orders will only be processed after payment has been received and verified.

Wacket shall not be responsible for payments made to any telephone number, person, account, or payment channel not officially communicated by Wacket.

5. Delivery

Delivery timelines are estimates and may vary depending on product availability, customer location, weather conditions, road accessibility, transportation challenges, and the nature of the products ordered.

Customers will be informed of significant delivery delays where possible.

6. Inspection, Acceptance, Returns and Refunds

Customers must inspect their orders immediately upon delivery.

Any concerns regarding quantity, quality, spoilage, damage, missing items, or incorrect products must be reported and verified before the delivery representative leaves the delivery location.

Once an order has been accepted and the delivery representative has departed, the products shall be deemed to have been received in satisfactory condition.

Due to the perishable nature of many products, returns and refunds may not be available after acceptance of delivery.

7. Customer Responsibilities

Customers are responsible for:

  • Providing accurate delivery information.
  • Being available to receive deliveries or appointing an authorized representative.
  • Inspecting products upon delivery.
  • Properly storing and handling products after delivery.
  • Using the Wacket platform lawfully and responsibly.

8. User Accounts and Security

Where user accounts are provided, customers are responsible for maintaining the confidentiality and security of their account credentials.

Customers are responsible for activities conducted through their accounts and should immediately notify Wacket of any suspected unauthorized access or security breach.

9. Platform Updates and Communications

By using Wacket, customers consent to receive communications through the platform, SMS, email, telephone calls, messaging applications, and other communication channels used by Wacket.

Wacket may introduce, modify, replace, suspend, or discontinue platform features, payment systems, communication channels, delivery methods, transportation systems, security measures, and other services from time to time.

Customers are responsible for reviewing updates, notices, and revised Terms & Conditions published by Wacket.

10. Respectful Conduct

All users of Wacket must treat customers, producers, suppliers, delivery personnel, customer service representatives, employees, and partners with respect.

Harassment, threats, intimidation, discrimination, abuse, misconduct, fraudulent behaviour, or any conduct that may harm, embarrass, endanger, or interfere with another person will not be tolerated.

Wacket reserves the right to investigate complaints and to refuse, suspend, restrict, terminate access to its services where necessary or evoke legal remedies, if necessary.

11. Supplier Independence

Producers and suppliers participating in Wacket remain independent individuals, businesses, groups, cooperatives, or entities.

Participation in the platform does not create an employment relationship, partnership, joint venture, agency relationship, or ownership interest between Wacket and any producer or supplier unless expressly agreed in writing.

12. Environmental Commitment

Wacket is committed to promoting sustainable sourcing, responsible transportation, waste reduction, and environmentally conscious packaging where reasonably available and practical.

However, operational, financial, technological, supply chain, and market conditions may affect the availability of certain sustainability measures. Wacket does not guarantee that all products, packaging materials, suppliers, transportation methods, or operational processes will always meet specific environmental or eco-friendly standards.

13. Intellectual Property

The Wacket name, logo, branding, packaging designs, website content, application content, graphics, images, text, databases, and other proprietary materials belong to Wacket or its licensors.

No person may copy, reproduce, distribute, modify, publish, sell, license, or otherwise use Wacket intellectual property without prior written permission.

14. Privacy

Wacket may collect and process customer information necessary for order processing, payment verification, delivery coordination, customer support, platform improvement, legal compliance, and related business purposes.

Wacket will take reasonable measures to safeguard customer information in accordance with applicable laws.

15. Liability, Force Majeure and Governing Law

Wacket shall not be liable for losses, damages, spoilage, deterioration, delays, or quality concerns arising after products have been accepted by the customer or their authorized representative.

Wacket shall not be liable for delays or interruptions caused by circumstances beyond its reasonable control, including severe weather, floods, droughts, natural disasters, transportation disruptions, supplier interruptions, labour disputes, government restrictions, epidemics, pandemics, or other unforeseen events.

If any part of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in effect.

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Uganda. Any dispute arising from the use of Wacket shall be subject to the jurisdiction of the competent courts and tribunals of Uganda.

16. Changes to These Terms

Wacket may revise these Terms & Conditions at any time.

Updated versions shall become effective upon publication on the Wacket platform, website, mobile application, or other official communication channels.

Continued use of Wacket services constitutes acceptance of any revised Terms & Conditions.
